Terms of Service

These Terms apply to www.open-source-lab.com and www.playground.open-source-lab.com, including their features and pages (together, the “Services”). They explain the rules for browsing the model catalogue and using the Open-Source-Lab Playground.

1. Agreement and operator

These Terms form an agreement between you and Open-Source-Lab, which operates the Services. By accessing or using either Service, you agree to these Terms. If you use a Service for an organization, you confirm that you have authority to accept these Terms for it. If you do not agree, do not use the Services.

2. Age and eligibility

You must be at least 13 years old, or older if your local law sets a higher minimum age for using the Services. If you are under the age of legal majority where you live, you may use the Services only with a parent or guardian’s permission where the law requires it. The Services are not intended for children under 13.

3. The Services

The model catalogue helps you browse, search, save, and compare information about AI models, including model descriptions, publishers, benchmarks, licences, and places to access or download them. The Playground lets you send prompts to selected AI models through connected providers and may include a shared community Guestbook. Guestbook messages are visible to other Playground visitors. Some features may be available to guests; others may require an account or paid plan.

We may change, suspend, or discontinue a feature, model route, or part of a Service. Availability, model listings, and feature limits may change without notice, including when a model publisher or provider changes its offering.

4. Accounts and access

You are responsible for keeping your sign-in details secure and for activity through your account. Provide accurate information and tell us promptly if you believe your account has been accessed without permission. Do not share credentials in a way that gives someone else control of your account.

The Playground may let you sign in by email or through ChatGPT. A third-party sign-in provider controls its own account and authentication services. You may use the Playground as a guest where that option is available; guest features and usage limits may differ from account features.

5. Models and AI responses

Catalogue information can come from model publishers, providers, benchmark publishers, or other sources. It may be incomplete, outdated, or different from the current model or licence. A listing or benchmark is not an endorsement. Check the model publisher’s original information and licence before downloading, deploying, or using a model. “Open-weight” and “open-source” do not mean that every model has the same rights or restrictions.

When you use the Playground, your prompt and the conversation context needed to answer it are sent to the provider you select. Current providers include Poe, DeepSeek, Groq, NVIDIA, EmpirioLabs AI, Mistral AI, and OpenRouter. Those providers may apply their own terms, usage rules, limits, fees, and data practices. We do not control their services.

AI responses can be wrong, misleading, offensive, biased, or out of date. They may not reflect Open-Source-Lab’s views and may be similar to responses given to other people. Do not rely on them as professional medical, legal, financial, or other regulated advice, or for emergencies. Independently verify information and have a qualified person review anything important before acting on it.

6. Your content and shared chats

You keep any rights you have in the prompts, files, messages, and other material you submit. You are responsible for that material and must have the rights and permissions needed to submit it and use the responses. You give us a limited, non-exclusive permission to host, store, format, transmit, and display your content as needed to provide, maintain, and protect the features you choose, including displaying Guestbook posts and using a sharing feature you choose.

If you create a shared-chat link, anyone who obtains that link may be able to view the conversation included in it. You are responsible for deciding what to share and with whom. Do not create or distribute a link for information you want to keep private.

Guestbook posts are displayed to other Playground visitors with the community name shown beside the post. By posting, you ask us to make that message visible in the Guestbook. Do not post private or sensitive information. We may remove a post or limit posting when needed to enforce these Terms, comply with law, or protect the Services and their users.

Rights in AI responses depend on the model and provider involved. We do not promise that an output is unique, non-infringing, or available for any particular use. Provider terms may place additional conditions on your use of prompts or responses.

7. Rules for using the Services

Use the Services lawfully and respect other people’s rights. You may not, and may not help anyone else to:

  • use a Service or model to violate the law, infringe rights, defraud, threaten, or harm another person;
  • upload malware, probe or disrupt systems, bypass safeguards, or interfere with the security or operation of a Service or provider;
  • evade usage limits, abuse an account or provider key, or make automated requests that overload the Services or breach applicable rate limits;
  • systematically scrape, harvest, or extract Service data without permission, except where applicable law permits it;
  • reverse engineer or attempt to access non-public parts of the Services, except where applicable law does not allow that restriction; or
  • mislead others about AI-generated material when doing so would be deceptive, or use an output as though it were verified professional advice.

You must also follow the rules of the model provider you choose. We may restrict activity that violates these Terms or creates a security, legal, or operational risk.

8. Subscriptions and provider charges

If we offer a paid Playground plan, its features, price, currency, billing period, and any renewal terms will be shown before you subscribe. Current recurring Playground plans are billed monthly in US dollars through Stripe. By subscribing, you authorize the displayed recurring charge until you cancel. To cancel, use any available billing controls or contact info@open-source-lab.com before your next renewal. Deleting your Playground account or data cancels its active subscription immediately.

Refunds and cancellation rights are handled as stated at checkout and under applicable law. A Playground plan is separate from any charges, credits, points, or subscriptions imposed by an AI model provider. When you use your own provider account or API key, that provider’s rates, limits, billing, and payment terms apply; we do not issue those provider invoices.

9. Our rights

Open-Source-Lab and its licensors retain rights in the Services, including their software, design, name, logos, and catalogue compilation, except for content owned by users or third parties. We give you a limited, non-exclusive, non-transferable right to access and use the Services as intended and in line with these Terms.

Model weights, model names, datasets, benchmarks, and other third-party materials remain subject to their owners’ rights and licences. These Terms do not grant you rights to them. Follow the licence and terms supplied by the relevant owner or provider.

10. Privacy and third parties

Our Privacy Policy explains how information is handled across the catalogue and Playground. The Cookie Policy describes cookies and similar storage. These Terms do not replace those policies.

The Services may link to or connect with independent websites, model providers, payment services, or sign-in services. Those third parties set their own terms and privacy practices. Review them before using the relevant service. We are not responsible for third-party services we do not operate.

11. Suspension and ending use

You may stop using the Services at any time. You can delete Playground chats or account data through the controls available in the Playground. Account deletion cancels an active Playground subscription as described above. The Privacy Policy explains how deletion and retention work for different information.

We may suspend or end your access if you breach these Terms, if we must do so by law, or if your use creates a serious security, legal, or operational risk. We may also discontinue a Service or feature. We will provide notice when required by law.

12. Disclaimers and liability

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We do not guarantee that a Service will be uninterrupted, secure, error-free, or suitable for a particular purpose, or that catalogue information, provider services, or AI responses will be accurate or available.

To the maximum extent permitted by law, Open-Source-Lab is not liable for indirect, incidental, special, consequential, or punitive loss, or for lost profits, data, or goodwill. Our total liability for claims relating to the Services will not exceed the greater of the amount you paid to us for the Services in the 12 months before the event giving rise to the claim and US$100.

Nothing in these Terms excludes or limits a responsibility or right that applicable law does not allow to be excluded or limited, including any mandatory consumer rights.

13. Changes and legal terms

We may update these Terms as the Services or laws change. We will post the new version here and change the “Last updated” date. If a change materially affects your rights, we will provide notice where required by law. Your continued use after the effective date means you accept the updated Terms. If you do not agree, stop using the Services.

If a court finds a part of these Terms unenforceable, the rest will remain in effect to the extent the law allows. These Terms do not remove consumer protections or court rights that apply where you live. Disputes are subject to the law and courts that apply to your circumstances; nothing here prevents you from using a mandatory legal right or remedy.
